Amendments to Public Procurement Law

The amended Public Procurement Law Act, containing vital provisions concerning subcontractors, is only awaiting publication in the Journal of Laws; it will enter into force 14 days of the date of publication.

The amendments in question are aimed to comprehensively regulate the legal situation of subcontractors in public contracts. According to the explanatory memorandum to the draft amending law, the new rules are intended to ensure timely payment of remuneration due to subcontractors and, in addition, to provide a mechanism supporting execution quality in public contracts, in particular as a result of the award of public contracts to contractors with adequate capacities and by reducing the risk of disputes at the stage of public contract performance.
